User: A legally competent person of legal age or a legal entity registered as such under the laws of the Republic of Bulgaria, who has registered a User Account within the online shopping information platform.

Username: A unique code of letters, numbers, and symbols chosen by the User, through which they are identified in their relationship with the Provider.

Password: A code consisting of letters, numbers, and symbols which, together with the Username, identifies the User and serves as access credentials to their User Account.

User Account: A designated part of the website www.noteo.net containing information about the User, provided by them during registration and stored, used, and processed by “MPK TRADING”, a company registered under the Commercial Law of the Republic of Bulgaria, with a registered office and management address at: Varna, 6 Troleyina St., UIC 203136274 – solely for the purposes outlined in Article 4, Paragraph 1, Item 3 of the Personal Data Protection Act. Access to the User Account is granted by entering a Username (email) and password. The User Account allows the User to view and edit the data entered at registration at any time, provides full access to all purchase requests, and allows for opting out of receiving informational and promotional messages, among other features.

Price: The price displayed next to each item, representing the value per unit, expressed in Bulgarian leva and excluding delivery costs. If the price is stated in another currency, the sale price is converted into Bulgarian leva based on the daily exchange rate of the Bulgarian National Bank on the day the order is placed.

Delivery Price: The cost for delivering the ordered products, stated in Bulgarian leva.

Final Price: The total amount comprising the price of the selected item(s) along with the delivery price, stated in leva.

Item: A specific type of product, identified and individualized as such.

The online shopping information platform, located at the internet domain address www.noteo.net, provides Users with the opportunity to purchase goods with direct delivery after registering a User Account.

Account, Rights and Obligations of the User

The rules in this section of the General Terms and Conditions apply to Users who, based on the information provided during account registration, can be identified as consumers within the meaning of the Consumer Protection Act, the Electronic Commerce Act, and/or Directive 97/7/EC of the European Parliament and of the Council of 20 May 1997 on the protection of consumers in respect of distance contracts.

Steps

Both private individuals and legal entities, registered as such under the applicable legislation of the Republic of Bulgaria, may create a User Account on the online platform. In order to create an active User Account, the individual must complete the registration form available on the platform, providing a valid email address, full name, delivery address, contact phone number, and password. The completed form becomes an electronic document within the meaning of Article 3 of the Electronic Document and Electronic Signature Act (EDESA). Upon registration, the User explicitly confirms acceptance of these General Terms and Conditions, and in accordance with Article 3, paragraph 2 of EDESA, the written form is considered fulfilled and both parties are bound by the agreement.

By registering on the platform, the User confirms that the information provided in the registration form is accurate and does not infringe on the rights or interests of third parties. The PROVIDER confirms the registration made by the USER by sending a message to the email address specified by the USER, including information on how to activate the registration. In cases where the USER registers using a profile from a social media platform or another network, the party to the agreement is the person who is the holder of the profile used for the registration. In such cases, the PROVIDER is entitled to access the necessary data required to identify the User within the respective social or other network.

Rights and Obligations of Users

A. The User is responsible for all actions resulting from the use of the website through their account, including any contracts concluded and payments made. When using the online platform, Users must refrain from engaging in actions that violate the law.

B. When using the access provided to the electronic system, the User agrees to comply with Bulgarian legislation, applicable foreign laws, and these General Terms and Conditions. The User must not infringe upon the property or non-property rights of others, including intellectual property rights; must immediately notify the site of any violations that have occurred or have been discovered; must not interfere with the proper functioning of the system, including but not limited to obstructing the identification process of another User, accessing areas beyond the granted access, or damaging the availability, reliability, or quality of the provided access or using it in a way that prevents others from using it. Order

The prices of the goods and items offered through the online shopping platform accessible via the domain noteo.net are inclusive of VAT and exclude the delivery fee. The delivery price is determined separately during the order process.

Users use the interface on the page of “MPK Trading LTD” to conclude contracts for the sale of goods offered by the Provider through the online shopping information platform.

The contract is concluded in the Bulgarian language.

The contract between “MPK Trading LTD” and the User consists of these General Terms and Conditions, available at noteo.net.

The party to the contract with “MPK Trading LTD” is the User, according to the data provided during registration and contained in their personal profile.

This contract is considered concluded from the moment the User completes and confirms the registration form on the information platform regarding the respective order. The contract for the sale of a product is deemed concluded from the moment the User places the order through the Provider’s interface.

For the conclusion of this contract and for the conclusion of the contract for the sale of a product, the Provider explicitly notifies the User through appropriate electronic means, namely by sending an email to the address specified in the registration form.

“MPK TRADING LTD” delivers the goods to the address specified by the User and is not liable in cases where the provided information is incorrect, incomplete, or misleading.

Steps the User Must Follow to Place and Validate an Order:

• Registration – for new Users, or logging into the platform’s system – for registered Users;
• Selection of an item, based on type and characteristics;
• Adding the item to the “cart”;
• Choosing the payment method most convenient for the User, as well as the delivery method and address for the goods;
• Reviewing and accepting the General Terms and Conditions of Use;

After completing the above steps, the User must confirm the order once again on the website. This action validates the order and makes it binding for both parties.

Order Terms: The contract concluded between the User and the website is a distance sales contract under the conditions of advance payment or cash on delivery. The accepted methods and means of payment are:

– Advance bank transfer;

– Cash on delivery upon receipt of the goods.

Delivery

The User has the right to choose whether the ordered goods will be delivered directly to an address specified by them via courier, or to a courier office.

Deliveries are made not only within the territory of the Republic of Bulgaria.

The cost of courier and transportation services is not included in the price of the goods and items and is indicated separately. Transportation costs are at the User’s expense.

Delivery timeframe: The PROVIDER delivers the goods ordered by USERS within the timeframes (between 2 and 5 working days) and under the conditions specified on the online store’s website and in accordance with these General Terms and Conditions.. Orders are processed from Monday to Friday between 10:00 AM and 4:00 PM. Orders placed after 4:00 PM on weekdays are processed on the next business day. Orders placed on Saturday and Sunday are processed on the first following business day. The delivery time within the territory of the Republic of Bulgaria is from two to five working days. The Provider reserves the right to extend the delivery period by up to 30 working days in case of circumstances beyond the normal course of business. In such a case, the Provider will notify the User via email about the situation, available options, and their rights.

Liability

“MPK TRADING” LTD does not guarantee the accuracy, precision, or reliability of all materials contained on the Website. All materials are provided for informational purposes only and do not constitute advice for purchasing any particular product.

In the case of technical errors in the content, any validly concluded Sales Contracts shall remain binding on the parties unless such contracts are annulled in accordance with applicable law, in which case neither the User nor “MPK TRADING” LTD shall be liable for compensation to either party.

“MPK TRADING” LTD does not guarantee uninterrupted or fully reliable access to the Website and assumes no responsibility for any losses or damages resulting from access issues.

Withdrawal from Contract and Returns

Every USER has the right to return their order within 14 days from the date of delivery without providing a specific reason.

In the event of a withdrawal from the contract, the USER must return the order to the PROVIDER in its original commercial condition. The product will only be accepted for return if it is in its original packaging, with all labels and tags intact, and has not been used, soiled, damaged, or treated with any substances. The USER is required to complete a Return Form (LINK TO FORM) and attach the original payment document/receipt for the returned product. Returns must be made through a courier service.

The amount will be refunded to the USER’s bank account within up to 10 working days.

No refund will be issued if the USER has not returned the product to the PROVIDER.

The PROVIDER covers the return shipping costs in cases of defective products, damage during transport, and any other circumstances caused by the PROVIDER’s fault.

Applicable Law and Termination

The User’s contract with “MPK TRADING” LTD shall be terminated in the following cases:

• Upon dissolution and initiation of liquidation or declaration of bankruptcy of either party;
• By mutual written agreement between the parties;
• Unilaterally, with notice from either party in the event of non-performance by the other party;
• In the event of objective impossibility for either party to fulfill its contractual obligations;
• In the event that state authorities seize or seal the equipment;
• Upon deletion of the User’s registration from the online shopping information platform. In such cases, any concluded but unfulfilled contracts for the sale of goods shall remain valid and subject to execution;
• Upon exercise of the right of withdrawal under Article 55, Paragraph 1 of the Consumer Protection Act.
